Minors, students and training wages: who may be paid less than the rate on this page

Virginia's minimum wage rules cover workers who were previously excluded. Domestic service employees who work in private homes — such as companions, cooks, waiters, butlers, maids, valets and chauffeurs — are covered whether their work is permanent or temporary. Home care providers and certain babysitters are also covered. Virginia's law does not exempt employees based on the size of their employer, so workers at "small" businesses generally must be paid at least $12 per hour. However, Virginia does not set separate subminimum rates for minors or students based on age or student status, and it does not have a distinct training wage. The verified rate for the state in 2024 is $12 per hour, and that rate applies to all covered non-exempt employees regardless of the employer's size.

The Virginia Minimum Wage Act does not exempt employees based on the size of their employer.

Who to ask about this rate, and where to take a wage complaint

Questions or complaints about Virginia's minimum wage should be directed to the Virginia Department of Labor and Industry, Division of Labor and Employment Law, Labor Law Division. The division can be reached by phone at 804-786-2706, by fax at 804-371-4643, or by e-mail at laborlaw@doli.virginia.gov. The division's website is https://www.doli.virginia.gov/. Workers in Virginia who believe they are being paid less than the state's $12 per hour minimum wage, or whose employer is not properly accounting for tips or overtime, can contact the division to file a wage complaint. Additional statutory references are available through the Virginia Code online, and the federal Fair Labor Standards Act is also referenced for workers covered by both laws.

When tips, meals or lodging count toward the minimum wage

In Virginia, tipped employees are defined as workers who regularly receive more than $30 per month in tips. Employers may pay these employees a tipped minimum wage of $2.13 per hour, but the employee's hourly cash wage plus tips received must equal at least the full Virginia minimum wage of $12 per hour for every hour worked. If an employee's tips combined with the $2.13 cash wage fall short of $12 for any work hour, the employer must pay the difference so the employee earns at least $12 per hour. Virginia law does not allow employers to take a credit for the value of meals or lodging against the minimum wage in the same manner as tips; the tip credit is specifically authorized, and the $12 total must be met through cash wages and reported tips.

Tipped employees (those who regularly receive more than $30.00 a month in tips) may be paid at the tipped minimum wage of $2.13 per hour.

How the rate is adjusted each year, and who announces it

Virginia's minimum wage is adjusted annually based on the cost of living. Each year, the state calculates a cost-of-living adjustment to the minimum wage based on the Consumer Price Index for Urban Wage Earners and Clerical Workers (CPI-W). The adjustment is announced by the state and takes effect at the start of the calendar year. The verified rate for Virginia in 2024 is $12 per hour. This annual indexing means that workers in Virginia do not need to wait for new legislation to receive an increase tied to inflation; the rate rises automatically when the CPI-W indicates higher living costs. Employers in the state must update their pay rates each year to reflect the announced adjustment and must post the current rate so employees know what they are owed.
