Who to ask about this rate, and where to take a wage complaint

In Iowa, workers with wage complaints or questions about minimum wage rates have several options for assistance. The Iowa Department of Inspections, Appeals, and Licensing (DIAL) handles state wage claims. If you believe you are owed wages not exceeding $6,500, you can file a wage claim with DIAL by printing a form online or requesting one by mail at 515-725-5619. You also have the right to pursue your claim on your own behalf in court. For claims involving federal minimum wage or overtime, contact the U.S. Department of Labor, Wage & Hour Division at 515-284-4625. The federal training wage and other federal wage questions also go to that office. Iowa does not have a separate state labor office that handles these matters; DIAL is the relevant state agency for wage claims and enforcement of Iowa's minimum wage law.

If you believe you are owed wages not exceeding $6,500.00, you can file a wage claim with the DIAL. When tips, meals or lodging count toward the minimum wage

In Iowa, tips can count toward meeting the minimum wage requirement under specific conditions. If you earn $30 or more per month in tips, your employer may pay you as little as $4.35 per hour instead of the full $7.25 minimum wage. However, this tip credit only works if your hourly wage plus your tips average at least $7.25 per hour for every work week. If your total earnings fall below that threshold in any work week, your employer must pay you the difference to bring you up to the full minimum wage. The Iowa source document does not address whether meals or lodging can be credited toward the minimum wage. For information about meal or lodging credits under federal law, you would need to contact the U.S. Department of Labor's Wage and Hour Division.

If you make $30 per month or more in tips, the employer may pay as little as $4.35 per hour. If in any work week the wage the employer pays you and the tips you receive do not average at least $7.25 per hour, the employer is required to pay the difference.

What an employer may deduct from your pay

In Iowa, employers may deduct certain items from employee wages, but these deductions cannot reduce pay below the minimum wage unless specifically allowed. Deductions that are permitted include taxes, garnishments, and deductions for any lawful purpose that benefits the employee if the employee has given written authorization, such as insurance, 401K, pensions, bonds, and savings programs. However, Iowa law prohibits several types of deductions that could push wages below minimum wage. Employers cannot deduct cash shortages in common money till, losses due to breakage or damage, acceptance of bad checks, or default of customer credit except in certain limited cases. Lost or stolen property cannot be deducted unless specific conditions are met. Personal protective equipment generally cannot be deducted. For exceptions to these rules, see Iowa Code Chapter 91A.5.
