Overtime is paid at one and one-half times the regular rate
Under Illinois's overtime law, most hourly employees and some salaried employees must be paid at one and one-half times their regular rate of pay for every hour worked beyond 40 in a workweek. The rule applies by workweek, not by day or pay period, so an employer cannot average a long week with a short week to avoid the premium. Employees who are covered must receive the time-and-a-half rate on the paycheck that covers that workweek. The overtime premium is calculated on the worker's regular rate of pay, so it includes more than just the base hourly figure when other nondiscretionary payments are part of the worker's compensation. Employers should track hours across each seven-day workweek to be sure the 40-hour threshold is applied correctly.
