Common questions
- Did Hawaii's minimum wage change during 2022?
- Yes. The minimum wage was $10.10 per hour through September 30, 2022. A higher rate took effect on October 1, 2022.
- Was Hawaii's 2022 minimum wage different from the prior year?
- No. The $10.10 hourly rate in force from January 1, 2022 was the same as the minimum wage in 2021, which is why the year's first nine months brought no change for anyone paid at the state minimum.
Minors, students and training wages: who may be paid less than the rate on this page
Hawaii's minimum wage for 2022 is $10.10 per hour through September 30, 2022. Hawaii law allows certain workers to be paid less than the full minimum wage under specific circumstances. Under the state's tip credit provision, "tipped employees" may be paid up to 75 cents less per hour than the standard minimum wage. The state's subminimum wage provisions for other worker categories, such as minors or students in training programs, are established under Chapter 387 of the Hawaii Revised Statutes and Chapter 12-20 of the Hawaii Administrative Rules. Workers in Hawaii who believe they are being paid below the legal minimum wage should contact the Department of Labor and Industrial Relations to determine whether their employer qualifies for a special wage rate.

Who to ask about this rate, and where to take a wage complaint
The Hawaii Department of Labor and Industrial Relations is responsible for enforcing the state's Wage and Hour Law. If employees in Hawaii believe they have been underpaid, the department may recover back wages either administratively or through court action. For more information about the minimum wage or to ask questions about pay, workers can contact the nearest Department of Labor office. Hawaii maintains offices on Oahu, Kauai, Maui, Hawaii Island (Hilo), and West Hawaii (Kealakekua), each with a local phone number. The department also posts the official notice online at www.labor.hawaii.gov.

State minimum wage laws that give more than the federal rate
Hawaii's minimum wage under the Hawaii Wage and Hour Law also applies to employment covered by the federal Fair Labor Standards Act when the state's standards are higher than federal law. This means that when Hawaii's rate of $10.10 per hour exceeds the federal floor, workers in Hawaii are entitled to the higher state amount. Employers must follow whichever rate — state or federal — is more favorable to the employee. The law also requires employers to maintain time records. Because Hawaii sets its own rate above the federal minimum, workers in Hawaii receive the state's higher wage rather than the lower federal figure.
Minimum wage under the Hawaii Wage and Hour Law also applies to employment covered by the federal wage and hour law (Fair Labor Standards Act) when Hawaii standards are higher than the federal law.

When tips, meals or lodging count toward the minimum wage
Hawaii's Wage and Hour Law includes a tip credit provision. Under certain conditions, employers may pay tipped employees a cash wage that is lower than the full state minimum wage. Through September 30, 2022, the maximum tip credit is 75 cents per hour, meaning a tipped worker in Hawaii may receive a cash wage as low as the full minimum minus that amount. Beginning October 1, 2022, the credit increases to up to $1.00 per hour less. On January 1, 2024, it rises to up to $1.25 per hour less, and on January 1, 2028, it reaches up to $1.50 per hour less. These amounts are set by Section 387-2(b) of the Hawaii Revised Statutes. Workers in Hawaii who rely on tips should ensure their total pay, including tips received, equals at least the full state minimum wage.
TIP CREDIT - Under certain conditions, "tipped employees" may be paid up to 75 cents less per hour; effective October 1, 2022, up to $1.00 less per hour; effective January 1, 2024, up to $1.25 less per hour; and effective January 1, 2028, up to $1.50 less per hour.

Why the federal rate applies when the state rate is lower
Under the Hawaii Wage and Hour Law, the minimum wage rate in Hawaii is set by statute. The state has enacted a schedule of rate increases that goes beyond $10.10 per hour in future years. Because Hawaii's standards are higher than the federal rate, workers in Hawaii are entitled to the state amount rather than the lower federal floor. The law is codified in Chapter 387 of the Hawaii Revised Statutes and Chapter 12-20 of the Hawaii Administrative Rules. Employers covered by both the state and federal wage and hour laws must pay the higher of the two rates.
Minimum wage under the Hawaii Wage and Hour Law also applies to employment covered by the federal wage and hour law (Fair Labor Standards Act) when Hawaii standards are higher than the federal law.
